1. Who We Are

1.1. The website www.paddypower.com (and its associated Paddy Power branded websites (the "Websites"), the Mobile, Tablet and any other Paddy Power apps, (all of which together are referred to as the "Betting Apps"), Paddy Power Dial-a-Bet ("Dial-a-Bet") and Paddy Power Text Betting ("Text Betting") are operated and controlled by PPB Entertainment Ltd, PPB Counterparty Services Ltd and PPB Games Ltd, having their registered office at Triq il-Kappillan Mifsud, St. Venera, SVR 1851, Malta . These companies are wholly owned subsidiaries of Paddy Power Betfair Plc, an Irish company having its registered office at Power Tower, Belfield Office Park, Beech Hill Road, Clonskeagh, Dublin 4 (Ireland), registered at the Companies Registry Office, Ireland, under the number 16956.

1.2. References in these Terms and Conditions to "Paddy Power", "we", "us" or "our" will be to PPB Entertainment Ltd, PPB Counterparty Services Ltd and PPB Games Ltd.

1.3. PPB Entertainment Ltd is licenced and regulated by the Malta Gaming Authority to offer Games under licence number MGA/CL1/185/2004, issued on 01/07/2015. For customers in the UK, PPB Entertainment Ltd is licensed and regulated by the Gambling Commission.

1.4. PPB Counterparty Services Ltd is licenced and regulated by the Malta Gaming Authority to offer Sportsbook under licence number MGA/CL2/294/2006, issued on 12/03/2013. For customers in the UK, PPB Counterparty Services Ltd is licensed and regulated by the Gambling Commission.

1.5. PPB Games Ltd is licenced and regulated by the Malta Gaming Authority to offer Tote under licence number and MGA/CL3/207/2005, issued on 22/12/2012. For customers in the UK, PPB Games Ltd is licensed and regulated by the Gambling Commission.

1.6. Together, the Websites, the Betting Apps, Dial-a-Bet and Text Betting are referred to collectively herein as the "Paddy Power Services". Together, Paddy Power Services and the Additional Gaming Services (as defined in Clause 2.2) are referred to collectively herein as the "Services".

1.7. We reserve the right for each or any member of Paddy Power Betfair Plc group of companies (the “Paddy Power Group”) to exercise any of the rights or obligations of any other member of the Paddy Power Group under this agreement.

 

2. These Terms & Conditions and Your Relationship with Paddy Power

2.1. By visiting the Websites and/or by registering and/or using the Services, you agree to be, and are, bound by:

2.1.1. these Paddy Power Remote Gambling Terms and Conditions;

2.1.2. our Privacy Policy which is set out HERE

2.1.3. our Cookie Policy which is set out HERE

2.1.4. the Betting Rules; and

2.1.5. all such other of our terms and conditions, rules or policies as they relate to any applicable Services (e.g. rules for a particular game), promotions, bonuses, special offers or any other aspect of your use of the Services from time to time and are deemed to have accepted and understood all of the above.

2.2. In addition, where you use any of the betting or gaming services referred to in this Clause 2.2 ("Additional Gaming Services"), you also agree to be bound by the terms and conditions associated with each of those services, including but not limited to the terms and conditions of third party service providers where indicated:

2.3. All of the terms and conditions, rules and policies referred to in Clauses 2.1 and 2.2 shall be collectively referred to as the "Terms of Use".

2.4. Your use of the Services will constitute acceptance of the Terms of Use, to include any amendments thereto. If you do not agree to accept and be bound by the Terms of Use, please discontinue your use of the Services and the Websites.

 

3. Amending the Terms of Use and/or Services

3.1. Paddy Power reserves the right to amend the Terms of Use at any time, as may be required for a number of reasons including (without limitation) for commercial reasons, to comply with law or regulations, to comply with instructions, guidance or recommendations from a regulatory body, or for customer service reasons. Where we wish to make material changes to the Terms of Use, we will give you as much prior notice of such changes as is reasonably practicable but in any event customers will be notified of material changes before they come into effect. Any such revision will be binding and effective from such date as is specified in such notice. Your continued use of the site will be deemed to be your acceptance of any changes we may make. The date on which each relevant document comprising the then current Terms of Use came into (or will come into) force will be as stated in the date contained at the bottom of the Terms of Use page. Please check these Terms of Use frequently for updates.

3.2. Paddy Power may, in its absolute discretion, alter or amend or withdraw any betting or gaming from the Services or any part thereof, at any time, and may alter prices, features, specifications, capabilities, functions and/or other characteristics of the bets, games and/or Services.

3.3. Paddy Power may also at its discretion engage new or alternative third party service providers in respect of Additional Gaming Services or any other of its Services. By registering or playing with any such third parties, you thereby provide your consent to any applicable additional terms and conditions of such third parties as they may be amended from time to time, including but not limited to any change to the third party service provider itself.

 

4. Pre-Conditions to Opening an Account

4.1. In order to register an account (an "Account") with us you hereby agree, warrant and represent that:

4.1.1. you are at least 18 years of age. It is an offence for anyone under the age of 18 to open an account or to gamble with Paddy Power. We reserve the right to request proof of age documentation from any applicant or customer at any time and to void any wagers with minors;

4.1.2. you agree to provide accurate registration information when opening your account, including without limitation your correct date of birth, together with valid identification proving same, your country of residence, your current address, email address and personal telephone number. You further agree to inform us of any changes in such details;

4.1.3. you acknowledge that you are opening your account with Paddy Power solely for your personal use, and are acting as a principal and not as an agent on behalf of a third party;

4.1.4. you will not attempt to sell or otherwise transfer the benefit of your account to any third party and nor will you acquire or attempt to acquire an account which has been opened in the name of a third party;

4.1.5. you are entirely responsible for complying (and that you comply) with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an Account, placing any bets, stakes or wagers (together "Bets") or using the Services. In particular, if you are located in a country where use of a particular service is prohibited, you must not (i) register with us for the applicable Service; (ii) attempt to use that Service; or (iii) use your payment card or other payment method to undertake betting or gaming with us for the unlawful Service;

4.1.6. you are legally capable of entering into binding contracts, including these Terms of Use and each subsequent Bet (which shall be governed by these Terms of Use);

4.1.7. you are not prohibited for any reason from betting with us or from using the Services; and

4.1.8. you are not currently subject to a self-exclusion from a Paddy Power or Betfair account and neither we nor any other operator has excluded you, from gambling.

4.2. For various legal, regulatory, commercial and/or other reasons, we do not permit Accounts to be opened by persons who are located in certain territories (and we do not permit Accounts to be accessed and operated in those territories). The territories which are prohibited may be changed by us from time to time, in accordance with Clause 3.1, with or without prior notice to you.

4.3. The availability of our Services does not constitute an offer, solicitation or invitation by us for the use of our Services in any jurisdictions in which such use is prohibited by law. Paddy Power shall not be liable for any breach of any local, national, federal, state or other laws that may occur as a result of your using the Services.

4.4. In the event that you are found to have breached any of the terms in Clauses 4.1, 4.2 or 4.3:

4.4.1. we may cancel any Bet you may have placed;

4.4.2. we shall not be obliged to pay any winnings which might otherwise have been payable in respect of any Bet you placed; and

4.4.3. we may refer the matter to the police, guardians or family members, or any other appropriate regulatory authority.

 

5. Opening an Account

5.1. To open an Account, each customer will choose its own confidential username and password, except for Dial-a-Bet, which automatically assigns the customer a username.

5.2. It is the responsibility of each customer to ensure that all personal details are current and up-to-date, as failure to do so may result in Bets or payments being declined or payments being issued incorrectly. You can update your personal details via the Websites, by chat, by telephone, via Dial-a-Bet or the Betting Apps.

5.3. One Account is permitted per customer. Paddy Power reserves the right to close down any duplicate Accounts and to cancel any Bets on duplicate Accounts. Paddy Power also reserves the right to suspend or close any Account and cancel any associated Bets where the Account holder and the owner of the funding instrument are not the same.

5.4. Employees of the Paddy Power Group may not open an Account or register on the Websites or for any of the Services, whether in their own name or on behalf of a fellow employee, friend, relative or anyone else.

5.5. It is prohibited for players, deliberately or otherwise, to transfer money from one Paddy Power account to another for any reason.

 

6. Account Security

6.1. The username and password must be kept confidential by the customer. All Bets where a customer’s username and password (or such other criteria as may be required and as communicated to you, for example by Dial-a-Bet) have been correctly entered (which may be as a result of customer negligence) will be regarded as valid, provided that:

6.1.1. The Bet meets the other criteria for placing a Bet as laid down in these Terms of Use; and

6.1.2. Paddy Power has no other reason to believe at the time of acceptance of the Bet that the Bet was not placed by you.

Subject to the foregoing, Paddy Power will not be liable for any loss that you may incur as a result of misuse of usernames or passwords or from any unauthorised use of your Account, whether fraudulent or otherwise. You agree to indemnify us and hold us harmless against any costs, claims, damages and expenses arising in connection with the use of, or access to, your Account by any third party as a result of your negligence, breach of these Terms of Use, fraud, dishonesty or criminal activities.

6.2. Please contact us as soon as is possible if you have lost or forgotten your Account details. You agree to inform us as soon as is possible (by telephone, where possible) if you believe that your Account information is being misused by a third party so that we may suspend your Account to prevent further abuse.

6.3. We recommend that you disable any automatic password memory in your browser prior to using the Services. This will help to limit the risk to you of unauthorised use of your Account.

6.4. To bet or to play games for money on Paddy Power, you need to deposit funds. Except as set out below, all funds in customer accounts are held by The Sporting Exchange (Clients) Limited, a group company established solely for the purpose of holding customer funds (the “Trustee”), under the terms of the Trust Deed (the “Trust Fund”). Holding your money in the Trust Fund has the following benefits to you:

6.4.1. in the unlikely event that Paddy Power (or any other operating company within the Paddy Power Group) becomes subject to any insolvency proceedings, then your money will not be available to administrators/liquidators (or similar) and so you will be able to withdraw your money from your account as normal;

6.4.2. the law of equity (which governs this Trust Fund) provides additional remedies to all beneficiaries of the Trust Fund (i.e. to all Paddy Power customers) that may not otherwise exist in a contractual relationship (eg a duty to act in good faith); and

6.4.3. we have a number of additional controls in place over the Trust Fund to protect your money.

This arrangement meets the Gambling Commission's requirements for the protection of customer funds at the level: high

Your funds will not be held by the Trustee if: (i) there is a requirement for such funds to be held under the terms of any licence, in a separate non set-off bank account in the name of the licence holder; or (ii) where such funds are deposited via a third party payment provider (hereafter referred to as a “Payment Provider”). Funds deposited via a Payment Provider may take a few days before they are held by the Trustee under the terms of Trust Deed. During this period your funds will be held in the account of the relevant Payment Provider and will not be protected under the terms of the Trust Deed. Depositing by any method other than the following will be classed as a deposit via a third party Payment Provider: (a) bank transfer, (b) cheque, (c) credit card and (d) debit card.

The funds in your account are held on your behalf by way of security to meet any payment obligations you may incur as a result of betting or playing games on our site or using any of the products or services supplied by Paddy Power. Details of the manner in which the Trust is operated are set out in the Trust Deed.

6.5. Paddy Power reserves the right to refuse to register you as an account holder, either with or without cause. Paddy Power reserves the right to suspend or terminate your account at any time, either with or without cause, upon notice (we will use our reasonable endeavours to give such notice to you either before or after suspending or terminating your account). Following termination or suspension of your account, we will endeavour, in the normal course of events, to comply with any valid contractual obligations made in accordance with these Terms and Conditions.

6.6. The Paddy Power Group and any third parties it contracts with in relation to the provision of the Services will hold information with respect to your identity, including but not limited to your name, address and payment details, in accordance with our Privacy Policy and our Cookie Policy. We rely on this information in entering into this agreement with you. You agree to indemnify us and hold us harmless against any costs, claims, damages and expenses arising in connection with any falsehood or inaccuracy contained in the information you provide to us.

 

7. Deposits & Withdrawals

7.1. To participate in any real-money Bets available via the Services, you must deposit monies into your Account.

7.2. Customers can choose which currency is most convenient for them to manage their Account from the following list:

7.2.1. Pound Sterling GBP (£); and

7.2.2. Euro EUR (€).

7.2.3. Once an Account has been opened, the currency cannot subsequently be changed. All deposits and withdrawals shall be in these currencies.

7.2.4. As required by our anti-money laundering obligations and/or as part of our policy with regard to the source of funds placed on deposit, we reserve the right to raise queries regarding the source of any funds placed on deposit. Paddy Power may, acting reasonably, suspend or terminate any Account where the response to such query/queries is not in its view satisfactory and/or may pass on such information as it deems necessary to any relevant authority.

7.2.5. Cheques or bank drafts will only be credited to your Account upon clearance by our bank. Funds should be made payable to The Sporting Exchange (Clients) Ltd and sent to: Power Tower, Belfield Office Park, Beech Hill Road, Clonskeagh, Dublin 4 (Ireland). Once the balance on a deposit Account has been exhausted, no Bets will be accepted and any Bets taken in error will be declared void, win or lose.

7.2.6. Please note that minimum and maximum Account deposits apply, as will be indicated to you where relevant. Interest is not payable on Account balances. Credit is not permitted. It is your responsibility to maintain sufficient funds in your Account, and to stake your Bets accordingly. We reserve the right to void any Bet which may be inadvertently accepted if your Account does not have sufficient funds to cover the whole of the Bet and/or to recover the amount of any shortfall. The Sporting Exchange (Clients) Ltd is not a financial institution and no interest is payable on deposits.

7.2.7. Funds may be withdrawn from your Account provided that:

7.2.7.1. All payments made into your Account have been confirmed as cleared and have not been charged-back, reversed or otherwise cancelled;

7.2.7.2. Any identity checks we are required to conduct pursuant to applicable anti-money laundering regulations and rules or other obligations are clear. To this end we reserve the right to seek such other information as we might require in order to confirm your identity and compliance with these Terms of Use and any other applicable rules, laws or regulations. Please also note that additional verifications may be required in connection with certain services which may cause an additional delay when withdrawing funds; and

7.2.7.3. You have complied with the rest of these Terms of Use.

7.2.7.4. You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which Paddy Power deems suspicious, may be reported to the appropriate authorities. Paddy Power reserves the right to decline and/or reverse the withdrawal of unspent or otherwise unused deposits until the verification of these funds is deemed satisfactory.

7.2.8. We do not charge you for deposits or withdrawals although you should check with your bank and/or other payment service provider as to whether they will levy any such charges.

7.2.9. Please note that you (and not Paddy Power) are responsible for reporting or declaring any funds withdrawn, including any winnings, if such reporting is required by local law, tax or other authorities.

7.2.10. Any changes to your personal/card details must be advised to us as soon as is possible, as failure to do so may result in your deposit or Bets being declined by your bank.

7.2.11. As well as informing your bank, please inform us as soon as is possible should your bank card be lost or stolen.

7.2.12. If you or your bank advise us that your card has been lost or stolen, no further Bets will be accepted on your Account until you contact us with further instructions.

7.2.13. While we shall take all reasonable steps to avoid mistakes, outside of where we are negligent, Paddy Power cannot accept any responsibility or liability for any errors or omissions in respect of withdrawal of funds or lodgements to Accounts. Should funds be debited or credited incorrectly, it is the customer’s responsibility to notify Paddy Power without delay, and we shall endeavour to rectify such error.

7.2.14. On making a deposit to your account, Paddy Power may use your details to verify your identity as required pursuant to applicable anti-money laundering rules and regulations and/or other obligations, policies or procedures. Further, documentation may be required to verify your identity. Funds deposited from debit or credit cards will be credited to your Paddy Power Account as soon as is possible on receipt of an authorisation from your bank. It is your obligation to ensure that you keep these funds in your debit or credit card account until your bank deducts them.

7.2.15. You may set deposit limits within your Account. Please visit the My Account section when logged in or contact any of our Customer Support agents for further details.

 

8. Placing Bets

8.1. Customers can only bet up to the amount held within their Account or allowed by their bank or the limit as set out in the Betting Rules, whichever is the lesser. The minimum and maximum Bet per selection is determined exclusively by Paddy Power and is detailed on screen or will be communicated by the telephone operator, where relevant.

8.2. Paddy Power reserves the right to accept or decline the whole or part of any proposed Bet.

8.3. Bets placed by credit/debit card or any other means do not become valid until we have received payment or unless, at our discretion, we allow the Bet subject to authorisation. If payment has not been received before an event commences, then that Bet is automatically void unless we communicate otherwise to you at the time of the attempted placing of the Bet.

8.4. Each Bet will be given an individual number as confirmation of the Bet. Bets will be valid (subject to meeting the criteria for placing a Bet laid down in the Terms of Use) if accepted by the Paddy Power Bet Server, whether or not the customer receives the Bet code. We are not liable for the settlement of any Bets where we have not issued a written confirmation of acceptance of the Bet or where we are unable to display that Bet in the ‘My Account’ pages of the Websites. It is the customer’s responsibility to ensure that all of the details of their Bets are correct. Once a Bet has been confirmed by Paddy Power, that Bet cannot be cancelled by the customer. If you have any concern as to whether your Bet has been accepted, please log in and go to the ‘My Account’ pages of the Websites where details of all live Bets entered into by you will be displayed.

8.5. You must exercise your own judgement in placing a Bet and you hereby confirm that you have not relied on the advice of any Paddy Power employee relating to any Bet.

8.6. You agree to pay us for all Bets that are placed with us using your Account.

8.7. Bets must be made via the Websites, via the Betting Apps, via Dial-a-Bet or via Text Betting.

8.8. Please familiarise yourself with betting and gaming terminology and how the various bets and games are operated. If you have any queries relating to the foregoing, please contact us. Paddy Power cannot accept any responsibility if you place a Bet in circumstances where you do not fully understand any of the terms involved or how the bet or game is operated.

8.9. On occasion the prices available across the various Services may not be the same - for example, a price on the Websites may not be the same as those prices available at Paddy Power outlets or on Dial-a-Bet. Paddy Power accepts no liability for the fact that a customer could have obtained a different price through some other medium.

8.10. Guaranteed prices and other special offers or promotions are available at the discretion of Paddy Power and can be restricted on an individual Account basis at any time.

8.11. Paddy Power is not responsible for any taxes that may be payable by you whether on any Bets, on any winnings or otherwise.

8.12. With the exception of "Live Betting" events (see Clause 10 below for Live Betting rules), Bets are accepted up to the off-time of the event or a pre-determined time, whichever is earlier. However, Paddy Power may allow a grace period for some sporting events during which Bets will be accepted but we reserve the right to void any or all Bets should we think there has been a significant development in the event prior to placement or purported placement. Paddy Power reserves the right to void any Bet if accepted in error after the betting has closed or where the event was resolved or at a stage where the customer could have an indication of the outcome. In such circumstances, we will normally return your stake.

8.13. Paddy Power reserves the right to void any or all Bets made by, any group of people acting in conjunction with each other, or any individual acting alone, in an attempt to defraud Paddy Power.

8.14. Not all participants are quoted in every event. However, a price is available for almost all entries or outcomes in any event. If you wish to bet on an unnamed selection, please contact one of our Customer Support agents and we will endeavour to add this selection to the market.

8.15. Paddy Power may, at its sole discretion and without any requirement to give reasons, exclude any customer from the Services generally or from receiving selected promotions (e.g. guaranteed best price; bonuses; free bets; enhanced prices; and money-back specials) and any other promotions and offers introduced by us from time to time.

8.16. In the event of there being a dispute over the time at which a Bet was placed or whether a Bet has been placed, then the time at which it was recorded (if recorded) on the transactional log will govern settlement. If an attempted bet was not recorded on the transactional log, no Bet shall be deemed to have been placed. You should check your Account balance each time you visit the Websites.

8.17. It is a condition of our acceptance of Bets from you, and by offering to place a Bet with us you represent and warrant, that:

8.17.1. you are not prohibited from entering into the Bet by any term of your contract of employment, these Terms of Use or any rule of a sport governing body or other professional body of which you are a member, which applies to you;

8.17.2. where the Bet is placed on the outcome of a race, competition or other event or process or on the likelihood of anything occurring or not occurring ("the event"), you do not know the outcome of the event; and

8.17.3. you are not misusing Inside Information (as defined in Clause 8.22) to place a Bet.

8.18. In the event of any representation made by you in Clause 8.17 proving to be false, Paddy Power reserves the right to void bets, suspend your account, and we shall not be obliged to pay any winnings which might otherwise have been payable in respect of the Bet.

8.19. In the event of a warning being received by Paddy Power in relation to suspicious or irregular betting patterns and possible instances of event manipulation Paddy Power reserves the right, in its absolute discretion, to:

8.19.1. suspend its offering on any event or series of events in any of its markets; and

8.19.2. delay and/or withhold payment on any event or series of events until the integrity of such event or series of events has been confirmed:

i. by the relevant sports federation or governing body (where applicable); or

ii. by Paddy Power using its reasonable discretion.

8.20. Further, in the case of active event manipulation being confirmed as having taken place on any event or series of events (by the appropriate sports governing bodies or by any other means), Paddy Power reserves the right, in its absolute discretion, to suspend any Bets placed on such events, either by any individual identified as having misused Inside Information (defined in Clause 8.22) or by any other individual who in the reasonable opinion of Paddy Power is connected to, acting in conjunction with, or in any way involved with such individual or the event manipulation.

8.21. We reserve the right to refuse or limit any bets or bonuses (for example by setting minimum and maximum amounts which will be set out in the Betting Rules, or by setting wagering requirements), or change such limits, at our sole discretion for any reason whatsoever without any obligation to provide you with notice.

8.22. “Inside Information” means any information which has not been made public and, if it were made public, would be likely to have a material effect on the relevant market relating to the event.

Suspension or termination

8.23. Without restricting our ability to rely on other remedies that may be available to us, we may suspend or terminate your Account and/or cancel any Bets placed by you at our absolute discretion if:

8.23.1. We suspect that you:

i. are engaging in illegal or fraudulent activity while using our Services;

ii. are breaching any term of these Terms of Use, including the Betting Rules;

iii. are taking unfair advantage over us or any other player or are otherwise acting in an unfair manner (for example, by exploiting a fault, loophole or error in our software, by collusion or by any other means);

iv. may be having difficulties obtaining credit, have become bankrupt or that you may have self-excluded; or

8.23.2. We are required to do so by law.

8.24. Irrespective of whether we suspend or terminate an Account and notwithstanding any other provisions in these Terms of Use, we may decide to cancel or void any Bets at our absolute discretion where:

8.24.1. there is a technological failure; or

8.24.2. where in our judgment, acting reasonably, there is a manifest error in the terms of a Bet offered to, or placed by, any party.

8.25. If you have a query relating to your Account, it is your responsibility to notify Paddy Power at the earliest opportunity, providing as much information as Paddy Power may require.

8.26. Following termination or suspension of your account, the Trustee will, in the normal course of events, return any funds in your account to you in accordance with the Trust Deed. However, we reserve the right to notify the Trustee to withhold the funds in your account from you pending the determination of any investigation (including any relevant external investigation) where:

8.26.1. we suspect you have acted in breach of these Terms of Use or any other agreement relevant to your activities on our site, including where we suspect the account has been linked with fraudulent or ‘suspicious betting’ activity (explained in Clause 9); and/or

8.26.2. we have to notify the Trustee to withhold the funds in your account by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority.

 

9. Suspicious Betting

9.1. For the purpose of this Clause 9, “suspicious betting” shall refer to where we have reasonable grounds to believe that a Bet or a number of Bets have been placed in suspicious circumstances. Suspicious betting shall include, but not be limited to:

9.1.1. where there is an inordinate frequency and/or highly unusual pattern of Bets (by comparison with betting norms) placed on the same selection(s) in a short space of time;

9.1.2. where there is an inordinate frequency and/or highly unusual pattern of Bets placed on the same selection(s) and where the theoretical probability of said selection(s) winning at the time of Bet(s) placement, based on the odds offered on the selection(s) at the time of Bet placement, is largely inconsistent with the theoretical probability of the same selection(s) winning calculated using their starting prices;

9.1.3. where the integrity of an event (or events) has been called into question, including, for example, but not limited to where one (or more) of the participants in an event displays exceptional form which we reasonably believe was known to you or someone connected to you at the time of bet placement but was concealed from the public generally in order to gain an unfair advantage in any bets placed on that event (or those events);

9.1.4. where we have reasonable grounds to suspect that a Bet or a string of connected Bets were placed robotically, by automated means, or otherwise than through the Account holder placing each Bet manually via their Account;

9.1.5. where we reasonably believe that you have used unfair external factors or influences connected with the event(s) the subject of any Bet(s);

9.1.6. where we reasonably suspect that you have opened duplicate Accounts or where we reasonably suspect that second or subsequent Accounts are under common control with your Account with a view to concealing the true worth, nature or pattern of Bets placed by you or on your behalf, even if second or subsequent Accounts are opened under different names;

9.1.7. where we otherwise believe, acting reasonably, that you are acting in concert with others or that you are acting other than on your own behalf; or

9.1.8. where we reasonably believe that Bets have been placed from a location or device other than the location or device which you claim to have used to place a Bet.

9.2. In the case of any of the activities contemplated by Clause 9.1, and without restricting our ability to rely on other remedies that may be available to us, we may, acting reasonably, and depending on the circumstances:

9.2.1. request such further information from you as may reasonably be required by us to investigate whether the Bet or Bets constitute suspicious betting for the purpose of Clause 9.1;

9.2.2. suspend or withhold payment of any amounts (or any parts thereof) pending the receipt by us of satisfactory evidence from you in order for us to determine (acting reasonably) that a Bet does not constitute a suspicious bet as such term is referred to in Clause 9.1. For example, but without limitation, where we suspect that a Bet or a string of connected Bets may have been placed robotically or by automated means, we may require you to provide reasonable evidence that each Bet was placed manually by you via your Account. You further acknowledge and accept that we reserve the right, at our sole discretion, to collect and process any information in connection with your betting patterns, personal data, depositing of funds and any other related information and inquiries that will help us to investigate any suspected breach of these Terms;

9.2.3. suspend or withhold payment of any amounts (or any parts thereof), usually for no longer than 30 days but where relevant for such longer period of time as may reasonably be required (for example, pending any investigations by Paddy Power, any sports governing body, a gambling regulator, a law enforcement authority or any other third party);

9.2.4. void a Bet or a string of connected Bets (including for example multiples) prior to the event. Where possible, we shall communicate to you in advance that the Bet(s) has (or have) been voided prior to the (first) event the subject of the Bet(s);

9.2.5. calculate any winnings based on the starting price of the event(s) the subject of the Bet(s). Where possible, we shall communicate to you in advance that any Bet(s) will be settled at the starting price; or

9.2.6. where there is an inordinate frequency and/or unusual pattern of Bets placed on the same selection(s) in a short space of time and where we have reasonable grounds to suspect that the Bets are connected Bets, limit the payment of winnings in respect of those Bets (and where necessary with such limitation applied across multiple accounts) to the maximum payout for individual Bets on any particular market or markets as set out in the Betting Rules.

9.3. Where we have reasonable grounds to believe that you have participated in, or have been connected with, any type of suspicious betting, we shall use our reasonable endeavours to investigate such matter, including but not limited to through the use of various collusion, suspicious betting, fraud and cheating detection practices which are used in the gambling industry.

9.4. We reserve the right to terminate an Account if we reasonably suspect any of the activities described in Clause 9.1 in connection with that Account.

9.5. Where a Bet is deemed to be, or is declared, void by us prior to an event, any sum deducted from your Account with respect to that Bet shall be credited to your Account.

9.6. We reserve the right to seek to recover from you any losses we suffer that are directly or indirectly connected to any of the activities contemplated in Clause 9.1. This right is without prejudice to any other rights (including common law rights) that we may have against you, whether under these Terms of Use or otherwise.

9.7. We will not be liable under any circumstances whatsoever for any loss you or any other person may incur as a result of the collusive or other behaviour in breach of this Clause 9. Further, we reserve the right, but shall not be obliged, to take any other actions in the case of any of the activities contemplated in Clause 9.1.

9.8. In exercising any of our rights under this Clause 9, we shall ensure that we exercise such rights in a manner which is fair to you and to our customers generally. If you have any comments or queries in respect of this Clause 9, please do not hesitate to contact us.

 

10. Live Betting & Cash Out

10.1. Live Betting (or Betting in Running) means betting that takes place while an event is in progress. In addition to the rest of these Terms of Use, the following rules apply to Live Betting:

10.1.1. we reserve the right to void any part of any, or all, Bets on any Live Betting event that is not completed (i.e. abandoned, postponed);

10.1.2. where a blatant or palpable error is made in offers made, prices offered or Bets accepted or in the in transmission of any event on which we have purported to offer Live Betting, Bets may be settled at the correct price at the time at which the Bet was placed, as determined by Paddy Power; or

10.1.3. where we have reasonable grounds to believe that a Bet is placed after the outcome of an event is known, we reserve the right to void the Bet.

10.2. Please note that in the case of Live Betting, you may not at any time be able to see or otherwise be provided with the most up-to-date information in relation to the relevant event, including for example (but without limitation), through delayed coverage, a slow connection or equipment, or other system flaws, faults, errors or service interruption. Paddy Power shall not be liable for any delay in relaying up-to-date information.

10.3. In addition to the rest of these terms relating to Live Betting (which apply equally to our Cash Out functionality), the rules relating to the Cash Out feature are further described here. Please note in particular that for a variety of reasons (including for example technical issues, human error, suspicions of fraud or other improprieties and/or other issues outside of our control), Paddy Power cannot guarantee the availability at all times of the Cash Out functionality, even where the functionality has been advertised in connection with a particular event. Please be aware and accept, therefore, that unless Cash Out is available and successfully exercised in connection with a particular Bet, your initial Bet will, unless otherwise provided in accordance with these Terms of Use, stand as originally placed.

 

11. Gaming

11.1. Certain games involve peer-to-peer events via the Websites where you will be playing against other customers. Please note that we cannot control certain actions of those customers, who may be for example undertaking fraudulent activities such as colluding with other third parties or using unfair external factors or influences. If you suspect a third party is colluding, cheating or undertaking a fraudulent activity, please let us know as soon as possible. We will take reasonable steps to prevent such unacceptable behaviour. However, we will not be liable for any loss or damage which you may incur as a result of such third party collusion, fraud, cheating or otherwise illegal activity.

11.2. This provision applies specifically to certain games which are tested by Paddy Power via the use of Random Number Generators (“RNGs”).

The Return To Player (“RTP”) percentage of a fixed odds game represents the theoretical payback of game over time expressed as a percentage of total amount staked. For certain games offered by Paddy Power, this theoretical payback percentage is verified by running a large number of transactions – typically in the range of 10 million - through the game to ensure that the expected payback is within an expected range of the theoretical RTP. For those games, the result is generated by an RNG, which guarantees that each game outcome is generated independently and entirely randomly.

Both the testing of the RTP and the RNG are completed by an independent, accredited testing house who perform certification testing on behalf of the appropriate licensing body for each game.

Details of the RTP percentages which are relevant to each of Paddy Power’s applicable games are included on each game’s information page.

For the avoidance of doubt, Paddy Power does not guarantee that any of the games it offers will pay out according to its RTP percentage in a single hand, spin or play (or, indeed, to an individual customer).

Paddy Power warrants and represents that it is, in respect of the games it offers, compliant with the RTP requirements of all the appropriate licensing bodies.

 

12. Dial-a-Bet

12.1. In addition to the rest of these Terms of Use, the following rules apply to Dial-a-Bet.

12.2. When registering your account for the first time with Dial-a-Bet, please follow the operator’s instructions carefully.

12.3. Withdrawal Options

By using your Dial-a-Bet Account number as the username to log in to the Websites, you can view your Bets online and withdraw your winnings at your convenience. Alternatively, you can call our Customer Support department at any time on UK 08000 565 275 or IRL 1800 238 888 to request a statement or request payment of winnings. If the options above are unsuitable, please contact our Customer Support department to make alternative arrangements.

12.4. Bank Authorisation

Your first Bet is debited directly from your debit card or credit card and any winnings that accrue will be credited to your Dial-a-Bet Account. Future Bets will be debited from your Dial-a-Bet Account balance until there are insufficient funds available, upon which, we shall debit your card. It is our policy to seek authorisation at the time the Bet is requested and customers are required to remain on the call until authorisation has been confirmed. Occasionally, we are unable to get a decision before the "Off" of a race/event, and in such circumstances we may accept the Bet subject to bank authorisation being obtained. In the event of our accepting a Bet in these circumstances and authorisation being declined by your bank, the Bet will be void, win or lose.

12.5. Security

In the interest of security and to resolve queries or disputes, all calls to Dial-a-Bet are recorded.

Customers should never reveal their Account details (username etc.) to anyone else. Other than where Paddy Power has been negligent, customers are responsible for all Bets where their name and Account details have been correctly quoted.

12.6. Bet Confirmation

Minimum (currently €10 or £10) and maximum stakes apply, as will be indicated to you where relevant. It is your responsibility to ensure that our Dial-a-Bet agent has interpreted your instructions correctly. These will be repeated back to you during the call. At the end of the call you will be asked to confirm that the total stake is correct. All Bets will stand in accordance with our interpretation of your instructions. Should you wish to have your Bet(s) repeated to you in its (their) entirety this can be requested from the telephonist at the time of Bet placement. Currently our minimum stake per call is £10 or €10, maximum stakes may also apply and you will be informed of this where relevant.

12.7. Disconnection

Should your call be disconnected prematurely, you should ring back as soon as possible to confirm if your Bet has been accepted. The Bet will stand provided we are satisfied your instructions were clear, these being acceptable by our trading department and there being sufficient funds available to place the Bet.

 

13. Text Betting & Paddy Power Messenger

13.1. In addition to the rest of these Terms of Use, the following rules apply to Text Betting and to & Bets placed via Paddy Power Messenger.

13.2. You must have registered an Account to use Text Betting. You cannot register an Account via Text Betting. Only the mobile phone number registered with your Account may be used to place Bets via Text Betting. It is possible to register an Account via Paddy Power Messenger.

13.3. Where we receive an offer to place a Bet from the mobile phone number associated with your Account or via Paddy Power Messenger, we may at our discretion, and subject to the rest of these terms, accept that Bet.

13.4. A bet shall not automatically be deemed to be valid by your sending an offer to bet to us in connection with your Account. As with any other electronic communication, for reasons outside of our (or your) control, we may not receive your offer to place a bet on time (or at all). Also, we reserve the right at our discretion to decline an offer by you to place a bet. Bets will be valid only if accepted by the Paddy Power Bet Server, which will be conclusive as to acceptance or otherwise. We will endeavour to send confirmation of Text Bets by sending a Bet Receipt but again we cannot guarantee delivery or receipt by you of a Bet Receipt.

13.5. We reserve the right, at our sole discretion and without being required to give any reasons, to restrict or place limitations on customers using Text Betting and/or Paddy Power Messenger or to limit the amount of any Bet, including for example by way of individual Bet limits, daily limits, or individual customer limits.

13.6. By using Text Betting and/or Paddy Power Messenger, you will automatically be opted in for communications from Paddy Power to enable us to respond with Bet Receipts and/or deal with any queries. If you wish to unsubscribe from marketing communications you can simply text the word STOP to 51465 (or with Paddy Power Messenger, text the word STOP via the app) at any time.

13.7. It is your responsibility to ensure the security of your mobile phone. Other than where Paddy Power has been negligent, we will not be liable for any loss that you may incur as a result of misuse or unauthorised use of your mobile phone number or Account, whether fraudulent or otherwise.

 

14. Betting Apps

14.1. In addition to the rest of these Terms of Use, and all other terms and conditions that apply (such as rules relating to bonuses or particular games and/or functionalities as can be found within Paddy Power Messenger or any other terms relating to any other Betting App), the following terms and conditions apply to the Betting Apps.

14.2. You accept that using the Betting Apps outside of a WiFi network may result in data charges from your mobile network provider. Paddy Power will not be responsible for any data charges incurred as a result of your using the Betting Apps.

14.3. If you suffer a disconnection or exit the application for any reason during a game where a further player action is required, then this game will be resumed from this point when you log back in to the application and launch the relevant game. If you have a winning hand(s)/game and are disconnected prior to being able to ‘gamble’ on a video, poker or slot game, your winnings will be credited to your Account and you will not have the option to gamble when you reconnect. If no further decisions or action are required in an individual game following disconnection/exit, for example after the wheel spin has commenced in a roulette game, then the game will be settled and the result displayed in your Account history.

14.4. Game rules for individual games can be found within the Betting Apps and on the applicable Websites (including where relevant the .mobi websites).

 

15. Winnings & Payment

15.1. All cleared winnings will be credited to the customer’s Account. Where a debit or credit card was used to make the initial deposit, all payments made to a customer as part of a withdrawal of funds will be made to the same debit or credit card used to deposit monies with Paddy Power. In the event of this not being possible, payments will be made by cheque, bank transfer or cash in accordance with the personal details stored in the customer’s Account.

15.2. Please note that your bank can take up to 5 working days to return withdrawals to your debit or credit card. Our preferred method of payment is to return funds directly to the debit or credit card used to make the deposit. Cash withdrawals may be subject to certain criteria, for example payment of winnings will be made by bank transfer or cash upon request and will be sent to the address registered on the Account. Please see Clause 7.1.2 for further details on deposit/withdrawal methods.

15.3. Results will be as published and confirmed by the Press Association (to the extent applicable) or as otherwise generally accepted.

15.4. The maximum payout to any one customer in any twenty four hour period regardless of size of stake or number of Bets are as set out in the Betting Rules or as specified on the Bet Receipt, whichever is the lesser sum. Currency equivalent maximum payouts will apply for any currency not listed in the Betting Rules.

15.5. It is strictly the duty of the customer to stay within the limits set out in the Betting Rules and Paddy Power will not under any circumstances pay any amounts in excess of those limits to a customer for any purported winnings exceeding these limits.

15.6. Any queries relating to a Bet must be raised no later than six months after the last event in the Bet has been settled. We cannot guarantee that we will be able to respond to your query if it is not raised within this time. You may also raise your queries with any of the parties listed in Clause 32.

15.7. We may use your username and/or first name and/or initials and region and any winnings you may have had for advertising or promotional purposes without additional compensation.

 

16. Errors & Suspected Errors

16.1. Paddy Power makes every effort to ensure that no errors are made in prices offered or Bets accepted. However, human and/or systems’ error may occasionally result in errors.

16.1.1. Paddy Power reserves the right to correct any obvious errors and to void any Bets placed where such have occurred.

16.2. In the case of any blatant errors in prices transmitted (including for example where the price being displayed is materially different from those available in the general market and/or the price is clearly incorrect, depending on all of the circumstances), Bets will be settled at the correct price at the time of acceptance (or the Starting Price in the case of horse-racing, whichever is the greater). If a Bet is accepted by us on an event where offering a price on the event itself (rather than the price) was in error, the Bet will be void and your stake will be returned.

16.3. In the event of errors relating to the random number generators used in certain of the Services, Paddy Power reserves the right to void all Bets on the games affected and your stake will be returned.

16.4. Should funds be credited to a customer’s Account in error, it is the customer’s responsibility to notify Paddy Power of the error without delay. Any winnings subsequent to the error and prior to the notification of Paddy Power, whether linked to the error or not, shall be deemed invalid and returned to, or otherwise be reclaimable by, Paddy Power.

16.5. Any monies which are credited to your Account, or paid to you as a result of an error shall be deemed, pending resolution under Clause 16.1.1 to be held by you on trust for us and shall be immediately repaid to us when a demand for payment is made by us to you. Where such circumstances exist, if you have monies in your Account we may reclaim these monies from your Account pursuant to Clause 18.2. We agree that we shall use reasonable endeavours to detect any errors and inform you of any such errors relating to you, your engagement with us, or your Account, as soon as reasonably practicable.

16.6. As soon as you suspect or become aware of an error you shall:

i. immediately cease play; and

ii. inform us as soon as reasonably practicable of any such error or suspected error.

16.7. Where you have used monies which have been credited to your Account or awarded to you as a result of an error to place subsequent bets or play games, we may cancel such bets and/or withhold any winnings which you may have won with such monies, and if we have paid out on any such bets or gaming activities, such amounts shall be deemed to be held by you on trust for us and shall be immediately repaid to us when a demand for payment is made by us to you.

16.8. If you are incorrectly awarded any winnings as a result of (a) any human error; (b) any bug, defect or error in the Software; or (c) the failure of the relevant Games product or the Software to operate in accordance with the rules of the relevant game, then Paddy Power will not be liable to pay you any such winnings and you agree to refund any such winnings that may have been paid to you as a result of such error or mistake.

16.9. By using our Services, you understand that we reserve the right to change or remove any of these Services at any time.

 

17. Charge-backs and Cancellation

17.1. You hereby agree, warrant and represent that no charge-backs or other cancelation of deposits will be made relating to your Account without our consent. In the event of any of the foregoing occurring, you agree to indemnify us and hold us harmless against any costs, claims, damages and expenses arising in connection therewith and to refund and compensate us for any losses we would otherwise incur arising from such actions including any expenses incurred by us in the process of recovering such amounts.

17.2. Cancellation - We may restrict your access to Paddy Power.com, suspend or terminate your account, withdraw your offers for bets, void any bets outstanding to your account, cancel any unmatched bets or cancel and void any outstanding or matched bets in our absolute discretion without cause at any time including if:

i. there is a technological failure;

ii. we suspect that you are engaging in illegal or fraudulent activity;

iii. we suspect that you have (or may have) breached any part of this Agreement;

iv. we suspect you are acting in a manner that is detrimental to the conduct of our business or which may result in legal liability for you, us or third parties;

v. we suspect that your account’s usage could represent ‘business usage’ (‘business usage’ includes any use by a betting operator or any use by an individual or organisation supplying data or services to a betting operator);

vi. we suspect that you may be having difficulties obtaining credit;

vii. we have the right to do so as set out in any of our other policies;

viii. you are prohibited from entering into a bet by any term of your contract of employment or any rule of a sport governing body or other professional body which applies to you; or

ix. you place a bet on any sporting match or event in which you take part.

In relation to any cancelled or void bets, we reserve the right to hold any money in your account relating to these bets to be paid to us or, if there are insufficient funds in your account, demand that you pay us the relevant outstanding amount relating to these bets.

 

18. Void Bets & Right of Set-Off

18.1. Paddy Power may be required by law to conduct certain checks on customers or those applying to open a new Account. Where we are required by law or otherwise determine to close an Account for a breach of these Terms of Use, your attention is brought to the following terms:

18.1.1. all previous Bets will be voidable at the option of Paddy Power and any winnings which you have accrued will be forfeited by you and you will return to us on demand any such funds which have been withdrawn from your Account; and

18.1.2. subject to Clause 17.1, any stakes for Bets made but for which the event is not yet completed will be returned to you other than in the event of any outstanding charge-backs or any other amounts owed to us at that time.

18.2. Paddy Power may at any time set off any amount on deposit in your Account against any amounts owed by you to Paddy Power.

 

19. Fraud

19.1. Paddy Power reserves the right to seek criminal or other sanctions against you if we suspect you have engaged in fraudulent, dishonest or criminal acts and we will disclose such information to the relevant authorities or other relevant third parties (for example, payment service providers) as may be necessary in this regard.

19.2. Paddy Power reserves the right to suspend or terminate any Account it believes to be involved in fraud, money laundering and/or any other form of illegal or suspicious activities and to report such details as it reasonably considers are necessary to relevant authorities.

19.3. You undertake that all money that you deposit in your account is untainted with any illegality and, in particular, does not originate from any illegal activity or source.

 

20. Responsible Gambling

20.1. Paddy Power provides a self-exclusion facility to help you if you feel that you have developed a gambling problem. For information on problem gambling generally, please follow the links at the bottom of this and/or other pages of the Websites.

20.2. At your request, we will as soon as is reasonably practicable apply best practices to prevent you from using your Account indefinitely. To this end, we may retain such personal data as is necessary (and for as long as is necessary which may be indefinitely) to implement the facility as effectively as possible, including for example your name, address and credit/debit card details.

20.3. Our self-exclusion facility involves a joint commitment between Paddy Power and you. We will take reasonable steps to prevent you re-opening your Account or opening a new Account but you must not attempt to re-open your Account or to try and open new Accounts. You agree that: (i) if you hold accounts with both Paddy Power and Betfair and have self-excluded from an account on either site, you will not access any account which you hold on the other site (and we reserve the right to prevent you from attempting to access such other site) and (ii) if you hold an account with either Paddy Power or Betfair and have self-excluded from either site, you will not attempt to register an account with the other site during your period of self-exclusion (and we reserve the right to prevent you from registering an account with such other site). We shall not be liable for any losses you or any third party may suffer if you circumvent our self-exclusion procedures and continue to use our Services or if you continue to gamble with any third party. You will inform us as soon as you become aware of any errors in respect your self-exclusion or of any player protection mechanisms we make available to you. If you do not inform us when you become aware of such errors, then we shall not be liable for any losses which you may suffer.

20.4. Self-excluding from Paddy Power will not affect your marketing preferences with third parties, including with advertising websites or other third party affiliates. We strongly recommend that you also contact such third parties and opt out from receiving any gambling related communications from them.

20.6. With effect from 30 December 2016, if you apply a self-exclusion to your Paddy Power account, we will also try to prevent you from accessing any account which you hold with Betfair (for the same period of self-exclusion that applies to your Paddy Power account). However, there may be circumstances (including where we are unable to link your Paddy Power account to your Betfair account) where we are unable to do so. For certainty, we therefore recommend that, where you apply a self-exclusion to your Paddy Power account, you also do so to your Betfair account (and any other online account which you hold).

20.7. Please note that, if you applied a self-exclusion to your Paddy Power account before 30 December 2016, we will not automatically take steps to apply that self-exclusion to your Betfair account. In these circumstances, we recommend that you separately seek a self-exclusion to your Betfair account (and any other online account which you hold). If you applied a self-exclusion to your Paddy Power account before 30 December 2016 and also wish to self-exclude from your Betfair account, you can do so via your online Paddy Power account or, alternatively, by contacting our customer services by using the contact information on the bottom of this page.

20.8. If you are a UK resident customer who has requested to self-exclude by using GAMSTOP, based on the information that you have provided to GAMSTOP, we will take reasonable steps to prevent you from transacting on your Paddy Power Account, as soon as is reasonably practicable, following your self-exclusion being registered with GAMSTOP. If you apply any player protection tools (e.g. Deposit Limit, Product Exclusion, Reality Check) to your Paddy Power Account, we will not take steps to apply the same player protection tool(s) to your Betfair account and we recommend that you separately seek to apply those player protection tools (or their equivalent) to any other online account which you hold (including your Betfair account).

21. Inactive Account Fees

21.1. Where a Paddy Power customer account has been inactive for a period exceeding thirteen (13) consecutive months, Paddy Power will apply an Inactive Account Fee. This Inactive Account Fee is £/€5, or the currency equivalent, per month. The fee will be deducted from your balance on a monthly basis until:

21.1.1. you reactivate your account by recording a transaction on it;

21.1.2. your account has been closed; or

21.1.3. your account balance reaches zero.

21.2. You will be notified via email after 12 months’ inactivity, and, after that, the monthly Inactive Account Fee will apply.

21.3. Paddy Power, upon request, will refund you 100% of any Inactive Account Fees which have been charged to your account balance. To start the refund process, you should contact our Customer Service.

21.4. Inactive Account Fees apply to all Paddy Power customers.

 

22. Closure of Accounts

22.1. Please contact our Customer Service if you wish to close your Account.

22.2. After your account has been closed, it will remain closed unless and until you ask for it to be re-opened. However, we may refuse to re-open your account in certain circumstances (including where a permanent exclusion or self-exclusion has been applied to your account pursuant to our responsible gambling practices - see Clause 20 above).

22.3. Account holders who wish to recover funds held in a closed, locked or excluded account are also advised to contact Customer Service.

22.4. We are entitled to close your Account at our discretion and without having to disclose any reasons, and where deemed necessary on written notice (or attempted notice) to you using the contact details you have provided. Any balance in your Account will be made available to you, provided that you have complied with these Terms of Use.

22.5. Your sole remedy in the event of termination of your Account by us for any reason shall be the re-imbursement of any undisputed Account balance you may then have (and we shall have no further liability to you whatsoever).

 

23. Software and Downloads

23.1. For certain of our Services, it may be necessary to download or otherwise use certain software, including software provided by third parties. In such circumstances, you may be required to enter into an end user licence agreement ("EULA") in respect of such software. You agree to be bound by the terms of any such agreement. You also agree not to interfere with, modify, decompile, copy, or reverse-engineer any software provided to you as part of the Services except as expressly permitted herein, in the EULA, or as permitted by law.

 

24. Systems Failure & Hacking and Other Offences

24.1. Paddy Power shall not be liable for any Bet not being placed for any reason (unless as a result of negligence by Paddy Power) or you being disconnected from the Services, including but not limited to failure or disconnection of computer, telecommunications services, internet or otherwise, and the balance of your Account will at all times be as is recorded on our server.

24.2. You warrant, represent and undertake that you shall not knowingly or negligently interrupt, corrupt or exploit for any purposes not intended by Paddy Power any of the Services, including for example by:

24.2.1. attempting to gain unauthorised access to any of the Services, the servers on which the Services are hosted or any server, computer or database connected to the Services;

24.2.2. using any features which may affect the function or performance of the Services in any way for example (but not limited to) releasing viruses, worms, trojans or similar material that may be malicious or harmful;

24.2.3. interfering or tampering with, removing or otherwise altering in any way, any information in any form which is included in or on any of the Services; or

24.2.4. attacking the Services via a denial-of-service attack or any other form of attack or interference.

24.3. We reserve the right to pursue you for any loss we suffer as a result of any infringement by you of any of your obligations under this Clause 24. Further, please be aware that we may share your details with law enforcement authorities in the case of any criminal, or suspected criminal, activities by you.

 

25. User Generated Content

25.1. Certain of the Services may invite or permit you to upload your own content ("User Generated Content"). Paddy Power does not exercise editorial control over, and therefore does not endorse any, User Generated Content, and we shall not be liable in relation to such User Generated Content. You understand and agree that you are solely responsible for your User Generated Content.

25.2. For any User Generated Content you provide, you hereby warrant, represent and undertake that such content:

25.2.1. is an original work created by you or you have a licence or the express consent of the owner to use the User Generated Content in that manner;

25.2.2. does not infringe any third party intellectual property rights or privacy rights anywhere in the world;

25.2.3. does not contain any defamatory or otherwise inappropriate materials or statements;

25.2.4. does not contain any form of malicious computer code (e.g. viruses, bugs, trojan horses etc.) which could disable or disrupt any of the Services;

25.2.5. complies with all applicable laws and regulations; and

25.2.6. may be used in connection with publicising and promoting Paddy Power and its Services.

25.3. Any User Generated Content you provide will be considered non-confidential and lawfully provided by you and you are automatically deemed to have granted us an irrevocable, transferable, royalty-free licence to copy, exhibit, publish, distribute or otherwise use and sub-licence that User Generated Content as we see fit, including for commercial purposes. Such uses may include in printed publications, multimedia presentations, on websites or in any other distribution media. You agree that Paddy Power may also use your name, likeness and any other biographical information contained in such User Generated Content as we see fit, including for commercial purposes. In addition, you waive any right to inspect or approve the finished product, including written copy, wherein your likeness or testimonial appears. For the avoidance of doubt, you agree that you will make no monetary or other claim against Paddy Power for its use of your User Generated Content.

25.4. You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents, employees and service providers (e.g. Facebook) harmless from any liabilities, claims, losses or damages (including reasonable legal fees), however caused, that may arise as a result of or in connection with any User Generated Content.

25.5. If you have any issues with User Generated Content provided by any other customer or if you would like to discuss our use (or non-use) of your User Generated Content, please let us know by contacting us at the details below. We reserve the right (but are not obliged to) to edit or remove User Generated Content.

 

26. Your Personal Data

26.1. It is your responsibility to ensure that personal information relating to you is kept up-to-date. We reserve the right to suspend or terminate your Account if we suspect this information to be inaccurate. We will process information about you in accordance with our Privacy Policy and our Cookie Policy.

 

27. No Warranty

27.1. THE SERVICES ARE PROVIDED ‘AS IS’ WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND, AND ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, FITNESS FOR ANY PARTICULAR PURPOSE, AND OF COMPLETENESS OR ACCURACY OF CONTENT ARE HEREBY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. NEITHER PADDY POWER NOR ANY OF ITS LICENSORS GIVES ANY WARRANTY THAT THE SUPPLY OF MATERIAL AND CONTENT ON THE WEBSITES (INCLUDING BUT NOT LIMITED TO RACING SILKS, FORM AND RACING PREVIEWS) WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE OR THAT THE WEBSITES AND THE SERVICES ARE FREE OF VIRUSES OR BUGS AND NO WARRANTIES ARE GIVEN AS TO THE ACCURACY OF MATERIAL OR CONTENT COMPRISING THE SERVICES.

 

28. Liability

28.1. YOU HEREBY ACCEPT THAT BY USING THE SERVICES, THERE IS A RISK THAT YOU MAY, AS WELL AS WINNING MONEY, LOSE MONEY. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR OWN RISK AND WE ACCEPT NO RESPONSIBILITY AND SHALL NOT BE LIABLE FOR ANY CONSEQUENCES THAT ARE ALLEGED TO HAVE OCCURRED THROUGH YOUR USE, OR MISUSE, OF THE SERVICES.

28.2. IF AND ONLY TO THE EXTENT THAT CLAUSE 28.1 DOES NOT APPLY, THE MAXIMUM LIABILITY OF PADDY POWER (AND/OR OUR THIRD PARTY SERVICE PROVIDERS, TO THE EXTENT RELEVANT) TO YOU ARISING OUT OF OR RELATING TO THE SERVICES AND/OR THE TERMS OF USE, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE SHALL BE LIMITED TO THE AVERAGE BALANCE HELD IN YOUR PADDY POWER ACCOUNT IN THE PREVIOUS SIX MONTHS (OR THE TERM OF THE ACCOUNT IN THE CASE OF ACCOUNTS OPEN FOR LESS THAN SIX MONTHS).

28.3. WE (AND/OR OUR THIRD PARTY SERVICE PROVIDERS, TO THE EXTENT RELEVANT) SHALL NOT BE LIABLE TO YOU IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE ARISING FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF BUSINESS INFORMATION, BUSINESS INTERRUPTION, LOSS OF REPUTATION, LOSS OF OPPORTUNITY, OR LOSS OF GOODWILL, OR FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS, EVEN IF SUCH LOSSES ARE FORESEEABLE OR IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SUCH LOSSES.

28.4. WE ARE NOT LIABLE FOR THE FAILURE OF ANY EQUIPMENT OR SOFTWARE, WHEREVER LOCATED OR ADMINISTERED, OR WHETHER UNDER OUR DIRECT CONTROL OR NOT, THAT MAY PREVENT THE OPERATION OF OUR SERVICES, IMPEDE THE PLACING OF ORDERS FOR BETS OR THE ACCEPTANCE OF BETS, OR PREVENT YOU FROM BEING ABLE TO CONTACT US. WE WILL NOT BE LIABLE FOR ANY LOSS OF CONTENT OR MATERIAL UPLOADED OR TRANSMITTED THROUGH THE WEBSITES AND YOU CONFIRM THAT WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY MODIFICATION TO, OR SUSPENSION OR DISCONTINUANCE OF, THE SERVICES. WE RESERVE THE RIGHT TO CANCEL OR SUSPEND THE SERVICES WITHOUT INCURRING ANY LIABILITY.

WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE THAT YOU MAY SUFFER BECAUSE OF ANY ACT OF GOD; POWER FAILURE; TRADE OR LABOUR DISPUTE; ACT, FAILURE OR OMISSION OF ANY GOVERNMENT OR AUTHORITY; OBSTRUCTION OR FAILURE OF TELECOMMUNICATION SERVICES OR NETWORKS; OR ANY OTHER ACT, OMISSION, DELAY OR FAILURE CAUSED BY A THIRD PARTY OR OTHERWISE OUTSIDE OF OUR CONTROL.

28.6. NOTWITHSTANDING THE REST OF THE TERMS OF THIS CLAUSE 28, NOTHING IN THESE TERMS OF USE SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR FRAUD, DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE OR ANY LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE EXCLUDED OR LIMITED AS A MATTER OF LAW.

 

29. Indemnity

29.1. You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or damages (including legal fees), caused as a result of customer negligence or other fault on the part of the customer, that may arise as a result of or in connection with inappropriate or unauthorised access to and use of the Services by you or by anyone else using your username and password and/or breach by you of any of the terms and conditions of these Terms of Use.

 

30. Intellectual Property Rights

30.1. Paddy Power is the owner or authorised user or licensee of all the intellectual property rights in the Services and their content including, without limitation, any copyright, patent, designs (registered or unregistered), trade marks, service marks, source codes, specifications, templates, graphics, logos or any right subsisting in Ireland or elsewhere in respect of content, databases, formats, interfaces, programming, the offering of services to other customers, software or any application for any of the foregoing and any modification, improvements, developments and enhancements thereof. Except as expressly provided herein, Paddy Power does not grant any express or implied right to you in any of its intellectual property rights or secret information.

30.2. All content and material on the Websites or otherwise accessible via the Services is provided for your own personal (i.e. not for business) usage and the distribution, reproduction or commercial exploitation of such content and material in any manner whatsoever without our express written consent is prohibited.

30.3. For the avoidance of any doubt you may use the data available from the Websites and the other Services (including for example odds, both live and historical) only as strictly required for your permitted personal, non-exclusive, non-sublicenseable, non-commercial purpose of availing of the Services. Any other use and/or reproduction of the data without prior written consent of Paddy Power is prohibited and will constitute a breach of these Terms of Use. Paddy Power reserves its right to take such action as it considers necessary, including issuing legal proceedings without further notice to you, in relation to any unauthorised use of its data or of the Websites or Services.

Video Coverage of UK Horse Races

(a) The live linear audio-visual coverage of UK horse races and related audio commentary distributed via broadband internet streaming made available on the Websites (the "Footage") is owned by Racing UK Limited ("Racing UK") and licensed to The Betting Site Limited ("TBS"). Racing UK shall remain the exclusive legal and beneficial owner of all copyright and intellectual property rights in the Footage in perpetuity. All rights not explicitly granted herein are reserved by Racing UK and TBS.

(b) You may view the Footage once on a personal computer screen for personal, private, domestic, non-commercial uses only in accordance with these terms and conditions. You shall not:

i. make the Footage available to anyone else;

ii. use or view the Footage other than as expressly permitted by these terms and conditions, or copy, relay, broadcast, or communicate the Footage to the public, nor may you include any portion of or all of the Footage in any equipment or item save as specifically permitted under these terms and conditions or develop any improvement or derivative works of any part or all of the Footage;

iii. save, edit, copy, amend, distort, modify, distribute, reformat, disassemble, delay or repeat the Footage and/or its transmission or do anything that is contrary to any of the moral rights or other rights of the copyright owner of the Footage;

iv. remove any product identification (including but not limited to screen icons), legend or notice, or any proprietary or copyright notice from any part of the Footage;

v. represent or claim that you own any part or all of the Footage or otherwise do anything that is inconsistent with TBS’ and/or Racing UK’s rights in the Footage;

vi. store or transmit any Footage to any publication, user group, other website, electronic bulletin board, mailing list, server or other storage device in any form;

vii. sell or commercially exploit any part or all of the Footage in any way.

(c) Each of or all of Racing UK, TBS and Trinity Mirror PLC and its group companies may enforce any provision of these terms and conditions against you in the name of Paddy Power.

Bet and Watch Service

(a) Use of the bet and watch service ("B&W Service") shall be subject to the following terms and conditions:

i. Use of the B&W Service may only be for personal, non-commercial purposes;

ii. access to the B&W Service is prohibited in betting premises;

iii. there shall be no reproduction, distribution or publication of the B&W Service or any content or data contained therein;

31.3. Severability

31.3.1. If any provision of these Terms of Use is held to be invalid, void or unenforceable by reason of any law, rule, administrative order or judicial decision, that provision will be, to the extent strictly necessary, severed from the remaining terms and conditions and that determination shall not affect the validity of the remaining provisions of these Terms of Use. 31.4. Waiver

31.4.1. Failure by Paddy Power to insist upon strict performance of any of your obligations or to exercise any of the rights or remedies to which we are entitled shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations and a waiver by us of any default shall not constitute a waiver of any subsequent default.

31.5. Notices

31.5.1. Notices and other communications delivered or mailed to the postal address or to the electronic-mail address provided by you shall, until we have received notice in writing of any different address, be deemed to have been personally delivered once sent whether actually received or not.

31.6. Interpretation

31.6.1. In the event of there being any conflict or inconsistency between the terms and conditions comprising these Terms of Use as identified in Clause 2, the order of precedence shall be as follows:

(i) the terms and conditions governing the Additional Gaming Services to the extent that they are relevant to the Additional Gaming Services; and then

(ii) the Betting Rules; and then

(iii) these Paddy Power Remote Gambling Terms & Conditions; and then

(iv) our Privacy Policy; and then

(v) our Cookie Policy; and then finally

(vi) any other of our terms and conditions, rules or policies as they relate to promotions, bonuses, special offers or any other aspect of your use of the Services from time to time.

31.7. Entire Agreement

31.7.1. These Terms of Use and any documents referred to herein represent the entire agreement between Paddy Power and you and supersede any prior agreement, understanding or arrangement, whether oral or in writing. We each acknowledge that we have not relied on any representation, undertaking or promise given by the other or implied from anything said or written in negotiations between us except as expressly stated in these Terms of Use.

31.8. English Language Version

These Terms and Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Terms and Conditions and any non-English versions, the English version shall prevail.

32.2 You may use the European Commission's Online Dispute Resolution platform available here instead of approaching the relevant arbiter directly. However, by doing so you will be directed to the relevant arbiter and this may prolong the dispute resolution process. The arbiter’s decision will be final (save in respect of any manifest error) subject to full representation being given to all parties involved.

Governing Law

32.3(a). If you reside in the UK, these Terms of Use will be governed by the laws of England and any claims or proceedings arising out of or in any way relating to the Services or these Terms of Use, shall be governed by the laws of England and the English Courts shall have exclusive jurisdiction over them.

32.3(b). If you reside anywhere other than the UK, these Terms of Use will be governed by the laws of Malta and any other claims or proceedings arising out of or in any way relating to the Services or these Terms of Use, shall be governed by the laws of Malta and the Maltese Courts shall have exclusive jurisdiction over them.

32.4. Notwithstanding Clauses 32.1, 32.2, 32.3(a) and/or 32.3(b), Paddy Power reserves the right to take legal action against any party in breach of these Terms of Use, at its election, in Ireland, the UK or the place of breach or the domicile of that party, and that party shall submit to the jurisdiction chosen by Paddy Power.

 

33. Chat Rooms/Forums

33.1. Any Paddy Power Chat Room and Forum made available from time to time (the “Paddy Power Chat Room”) is intended for legitimate comment and constructive discussion and the sharing of opinions on sport, gaming and other matters. Paddy Power reserves the right to restrict posting privileges of any users who have not funded their account, who have not placed at least one bet, and/or who have not been subject to a "Know Your Customer" evaluation to Paddy Powers satisfaction.

33.2. Use of the Paddy Power Chat Room is subject to the following terms and conditions in addition to the terms and conditions of Paddy Power. Paddy Power reserves the right to change its policies at any time with or without notice. By using (reading and/or posting in) the Chat Room, you enter a contract with Paddy Power and you agree to be bound by these terms and conditions.

33.3 Although Paddy Power does not moderate the Chat Room, all conversations may be logged and recorded and it has controls in place to monitor the use of the Chat Room servers in response to complaints. Paddy Power reserves the right to delete or refuse any posting and/or suspend or terminate any account for any reason at any time without notice. Paddy Power may revoke your Chat Room privileges if you act outside the guidelines set out in these terms and conditions.

33.4 All users of the Paddy Power Chat Rooms agree not to post any item or any links to content that Paddy Power deems to be or may amount to collusion or activities of a suspicious or criminal nature.

9.         CASINO CLUB REWARD POINTS

10.        LAW

2.         ERRORS

5.2 We take into account several factors when verifying your identity, such as your legal name, address and date of birth.  Where we are unsatisfied with the information you have provided to us during the registration process, or we have been unable to verify your age and/or identity to our satisfaction, we may request further information from you in order to verify your details, such as proof of current residential address etc.  Until we have verified this information to our satisfaction you will only be able to make deposits into your account, you will not be able to withdraw. 6.         TERMINATION

6.1 We may suspend or terminate your account, cancel any bets placed by you, remove any bonus monies in your account and/or take any other action we deem appropriate in our absolute discretion if: (i) we suspect that you are engaging in illegal or fraudulent activity while using the Bingo Website (including circumstances where we suspect you have attempted  to manipulate the operation of the Bingo Website or the normal play of Games thereon or have been involved in player collusion); (ii) we suspect you are in breach of any of these Conditions, the Terms and Conditions or the Rules; (iii) we suspect you are acting in a manner that is detrimental to the conduct of our business; (iv) we are required to do so by law; or (v) in our judgment, there is a manifest error or there is a technological failure affecting the Bingo Website. 

6.2 We reserve the general right at any time, and in our sole discretion, to suspend or terminate your account (or exclude you from any of our services) without further explanation if we consider it necessary to do so. In such circumstances, where deemed appropriate by us, we reserve the right to remove any bonus monies in your account.

6.3 Your sole remedy in the event of termination of your account by us for reasons outlined in clause 6.1 or clause 6.2 above shall be the re-imbursement of any undisputed account balance you may then have, subject to your having complied with these Conditions, the Terms and Conditions and the Rules. To the fullest extent permitted by law, we shall have no further liability to you whatsoever.

7.         GENERAL

8.         INACTIVE ACCOUNTS

8.1 Where a Paddy Power customer account has been inactive for a period exceeding twelve (12) consecutive months, Paddy Power will apply an Inactive Account Fee. This Inactive Account Fee is £/€5, or the currency equivalent, per month. The fee will be deducted from your balance on a monthly basis until:

(i)   you reactivate your account by recording a transaction on it;

 

(ii)  your account has been closed; or

 

(iii) your account balance reaches zero.

 

8.2 You will be notified via email after 12 months’ inactivity, and, after that, the monthly Inactive Account Fee will apply.

8.3 Paddy Power, upon request, will refund you 100% of any Inactive Account Fees which have been charged to your account balance. To start the refund process, you should contact our Customer Service.

9.         CHAT 

9.1 We reserve the right to moderate any chat on the Bingo Website and remove postings, including those which we consider to be abusive, those which promote competing services and/or those which are untrue, derogatory or critical of Paddy Power, the Website, the Bingo Website and/or a Game. In addition, you agree to observe and abide by any specific chat rules that we may post on any chat facility from time-to-time

9.2 You understand that the chat room and chat services on the Bingo Website are provided at our discretion and may be withdrawn at any time. This includes but is not limited to the disabling of a player's chat functionality. If players have their chat banned 3 times, their account may be subject to termination, at our discretion.

9.3 You agree that you will not: (i) discuss or announce your account balance as this may cause other players to feel embarrassed or uneasy; (ii) solicit players for "gifts" or "loans" of money or funds, for yourself or any other player; (iii) harass, slander, libel, insult, abuse, disrespect or threaten other players, us, or our employees including our Chat Managers (“CMs”); or (iv) discuss other bingo websites/competing services or advertise or recruit on behalf of such websites/services.

9.4 Player aliases must be in good taste. We reserve the right to request that a player change his/her alias, at our discretion. Should a player refuse to change /his/her alias within a 48 hour time period, he/she will be permanently blocked from the chat rooms.

9.5 Bonus funds in respect of chat room games may be awarded to active players (i.e. those who have purchased a bingo ticket in a bingo game which runs concurrently with the chat game in question). Our CMs will not hold bonus funds for players who are not participating in chat and if you do not respond to our CM, the bonus funds will be awarded to another player. We reserve right to refuse to credit your winnings and/or disqualify you from participating in future chat games where we determine you have abused a chat game offer.

10.       LAW

10.1 Subject to clause 7.19, should there be any claim or dispute relating to bets on the Bingo Website please contact us. If we are unable to settle the dispute, we will refer the dispute to the arbiter set out in the disputes clause in the terms and conditions of www.paddypower.com which are available at Part A above. The arbiter’s decision will be final (save in respect of any manifest error), subject to full representation being given to all parties involved. Any dispute as to the enforceability of bets on the Bingo Website shall be governed by the laws of Alderney.

10.2 All other disputes not covered by clause 10.1 and, subject to clause 10.3, any other claims or proceedings arising out of or in any way relating to the Bingo Website or these Conditions shall be governed by the laws of Ireland and the Irish Courts shall have exclusive jurisdiction for the purpose of any such proceedings arising out of or in any way relating to the Bingo Website or these Conditions.

10.3 Notwithstanding clauses 10.1 and 10.2, we reserve the right to take legal action against any party in breach of these Conditions, at our election, in Ireland or the place of breach or the domicile of that party, and that party shall submit to the jurisdiction chosen by us.

Despite these funds not being available for withdrawal they are available for use at the poker table.

6.2 In the case of suspicious/collusive play taking place on your account or another player account related to yours in any way, you acknowledge that we reserve the right to block access to the Poker Website by such accounts and suspend the use of and withdrawal of funds for an indefinite period in order to carry out the necessary investigations and verify the details registered to the account.

7.             PROMOTIONS

8.             SUSPENSION, RESTRICTION OR TERMINATION OF YOUR ACCOUNT

10.1 The Game may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Game and any bets placed on or via the Game.

10.2 All bets must be placed through the user interface provided on the Poker Website. Any betting through other means, including the use of a "robot" player, is strictly forbidden.

10.3 We reserve the right, in our sole discretion, to prohibit any player from participating in any and all Games and/or the Poker Website. We may, where situations warrant, freeze the chips, void bets, suspend or terminate the account of any player suspected of cheating in any form (which includes, without limitation, collusion or the exploitation of faults in software on the Poker Website). We further reserve the right to restrict seating and/or to prohibit players from playing in a particular Game, including restricting two or more players from playing together at the same Game.

10.4 We reserve the right to void any bet inadvertently accepted after the time for placing bets has closed or where the event was resolved or at a stage where the player could have any indication of the outcome.

11.          POKER RULES

11.1 The Game Rules and the House Rules on the Website and the Poker Website shall apply to your participation in a Game. In particular, you are not permitted to make a bet in excess of the value of chips on the table at the beginning of a hand. You are permitted to acquire additional chips only between hands. If you run out of chips during a hand, you are considered "all-in". You may not remove money from the table during a playing session. Taking money out of the Game and continuing to play is not allowed in a table bets format.

11.2 Players must refrain from "table talk" or "coffee-housing" or talking during a hand in a way that compromises an opponent's hand. This applies if you are playing in the hand or watching the hand. Repeated abuse of this aspect of player behaviour will result in suspension or permanent restriction of play.

11.3 Abusive or offensive language or other behaviour considered inappropriate by Paddy Power in the context of the Game will not be tolerated. Bad behaviour or offensive language identified by Paddy Power or brought to its attention will be dealt with swiftly, and may result in a suspension or loss of playing privileges or such other action as may be deemed necessary by us at our sole discretion.

11.4 You fully accept and agree that the random number generator software will determine all outcomes of the Games.

11.5 You acknowledge and agree that you shall not interfere, interrupt, attempt to interrupt, or attempt to manipulate the operations of the Website or the Poker Website or the normal play of any of the Games. Failure to comply with the preceding may lead to your exclusion from the site and to criminal and civil investigations.

12.          SERVER CRASH

12.1 If you have chips at a table during a server crash, the Game will be cancelled and all of your chips at the table and in play will be returned to your account. We, any member of the Paddy Power group of companies, our affiliates, agents and licensors shall not be liable for any loss resulting from delays or interruptions to play due to failure, breakdown, malfunction, disconnection from or interruption of electronic or mechanical equipment, of telephone, internet connection or other communications facilities, or due to any denial of service (DDOS) attack or other malevolent external interference with our site or any other causes over which we or they have no direct control.

12.2 In the event of a tournament crash, where less than half the players have been eliminated, the tournament will be cancelled and all monies refunded; where more than half the players have been eliminated the prize pool will be divided in half – all players will receive an equal share of half the prize money; and the other half of the prize money will be allocated to the chip leaders (chip leaders will be determined by the number of places the tournament would have paid) in proportion to their chip count.

12.3 In the event of systems, technological or communications failure or errors relating to the generation of any result, bet settlement or any other element of the Game or the Poker Website, we will not be liable to you as a result of any such errors and we reserve the right to void all related bets and plays on the Game in question.

13.          LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN ALL CIRCUMSTANCES OUR MAXIMUM LIABILITY, AND THE MAXIMUM LIABILITY OF ANY MEMBER OF THE PADDY POWER GROUP OF COMPANIES (EXCLUDING PAYMENT OF VALID UNDISPUTED BETS) TO YOU FOR ANY CLAIM IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR IN ANY OTHER CAUSE OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE POKER WEBSITE OR OUR SERVICE SHALL BE £2,000 (OR CURRENCY EQUIVALENT). WE SHALL NOT BE LIABLE FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, BUSINESS INFORMATION, BUSINESS INTERRUPTION, REPUTATION, OPPORTUNITY OR GOODWILL OR FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS, EVEN IF SUCH LOSSES ARE FORESEEABLE.

14.          THIRD PARTY CONTENT

You expressly acknowledge and agree that we shall not be liable to you for the content of or use by you of any information or services offered by third parties or affiliates advertising, marketing, or otherwise posting content through the Website (whether directly or via links to or from other sites or resources) nor can we be said to endorse the content of such advertisements or information and we make no warranties with respect to such content.

15.          INACTIVE ACCOUNTS

15.1 Where a Paddy Power customer account has been inactive for a period exceeding twelve (12) consecutive months, Paddy Power will apply an Inactive Account Fee. This Inactive Account Fee is £/€5, or the currency equivalent, per month. The fee will be deducted from your balance on a monthly basis until:

(i)   you reactivate your account by recording a transaction on it;

 

(ii)  your account has been closed; or

 

(iii) your account balance reaches zero.

 

15.2 You will be notified via email after 12 months’ inactivity, and, after that, the monthly Inactive Account Fee will apply.  Paddy Power, upon request, will refund you 100% of any Inactive Account Fees which have been charged to your account balance. To start the refund process, you should contact our Customer Service.  Inactive Account Fees apply to all Paddy Power customers.

15.3 At the discretion of the poker room, an inactive account may have its screen name recycled, and may forfeit any action points accrued. The poker room is not obliged to give any further justification for this action or notification to the player prior to the account being made inactive, although the poker room will attempt to give players prior notice.

16.          MISCELLANEOUS

16.1 Should there be any claim or dispute relating to bet(s) on the Poker Website, please contact us. If we are unable to settle the dispute, we will refer the dispute to the arbiter set out in the disputes clause in the terms and conditions of the Website (www.paddypower.com), available at here. Any dispute as to the enforceability of bets on the Poker Website shall be governed by the laws of Alderney. All other disputes or any other claims or proceedings arising out of or in any way relating to the Poker Website or these Conditions shall be governed by the laws of Ireland and the Irish Courts shall have exclusive jurisdiction for the purpose of any such proceedings arising out of or in any way relating to the Poker Website or these Conditions. Notwithstanding the foregoing, Paddy Power reserves the right to take legal action against any party in breach of these Conditions, at its election, in Ireland or the place of breach or the domicile of that party, and that party shall submit to the jurisdiction chosen by Paddy Power.

16.2 Use of the Poker Website by minors is prohibited. It is an offence for anyone under the age of 18 to open an account or to gamble with Paddy Power. You shall not attempt to open an account with us if you are under 18 years of age. We take into account several factors when verifying your identity, such as your legal name, address and date of birth. Where we are unsatisfied with the information you have provided to us during the registration process, or we have been unable to verify your age and/or identity to our satisfaction, we may request further information from you in order to verify your details, such as proof of current residential address etc. Until we have verified this information to our satisfaction you will only be able to make deposits into your account, you will not be able to withdraw. Failure to provide us with satisfactory information within the time period requested by us will result in the closure of your account (across all of our services). 16.4 If, for any reason, a court of competent jurisdiction finds any provision of these Conditions, or portion thereof, unenforceable, invalid, or unlawful, then the remainder of these Conditions shall continue in full force and effect and will be read to give maximum effect to the intention of the parties as reflected by its plain language.

16.5 We may, at our sole discretion and without any requirement to give reasons, exclude any customer from our services generally and/or from receiving selected promotions and offers introduced by us from time to time.

16.6 We reserve the right to suspend, discontinue, modify, remove or add to the Poker Website and/or any Games at our discretion with immediate effect and without any obligation to provide you with notice.

The following terms and conditions made available in this Part F (as updated by us from time to time in our discretion) (“these Conditions”) shall govern the relationship between you and us in relation to all play on the paddypowergames.com website (“the Games Website”) and any other Paddy Power websites where we refer to the applicability of these Conditions. Your use of the Games Website and/or your playing any game thereon or any game on any other Paddy Power website where we refer to the applicability of these Conditions (“Game”) means that you accept these Conditions which are legally binding. Please review these Conditions regularly to ensure you are up-to-date with all of the current terms as any changes we make will become effective on the date of publication and you will be deemed to be aware of such changes and bound by them.

3.              DISCONNECTION, MISUSE AND MALFUNCTION

3.2 Misuse, disconnection or system malfunction voids all bets, plays and pays.

4.             COMPLIANCE WITH LAW

We reserve the right to cooperate with law enforcement and other regulatory authorities, in investigating claims of illegal activity on the Games Website.

5.             TERMINATION

5.1 We may suspend or terminate your account and/or cancel any bets placed by you and remove any bonus monies in your account and/or take any other action we deem appropriate in our absolute discretion if: (i) we suspect that you are engaging in illegal or fraudulent activity while using the Games Website (including circumstances where we suspect you have attempted  to manipulate the operation of the Games Website or the normal play of Games thereon or have been involved in player collusion); (ii) we suspect you are in breach of any of these Conditions, the Terms and Conditions or the Rules; (iii) we suspect you are acting in a manner that is detrimental to the conduct of our business; (iv) we are required to do so by law; or (v) in our judgment, there is a manifest error or there is a technological failure affecting the Games Website.

5.2  We reserve the general right at any time, and in our sole discretion, to suspend or terminate your account (or exclude you from any of our services and/or from receiving selected promotions and offers) without further explanation if we consider it necessary to do so. In such circumstances, where deemed appropriate by us, we reserve the right to remove any bonus monies in your account.

5.3 Your sole remedy in the event of termination of your account by us for reasons outlined in clause 5.1 or clause 5.2 (“Termination”) above shall be the re-imbursement of any undisputed account balance you may then have. To the fullest extent permitted by law, we shall have no further liability to you whatsoever.

6.             GENERAL

6.1 Where applicable, maximum payouts will be indicated to you in the Rules or elsewhere on the Games Website.

6.2 Promotions on the Games Website will have their own individual terms and conditions which will govern your participation in the relevant promotion.

6.6  Your account is personal to you. You shall not allow others to use your account or to accept any prize or participate in any Game. Any person found to have violated this clause will be liable for all losses on the account but will not be entitled to collect any winnings. It is your responsibility to keep your password private and secure and you are solely responsible for the security of your account information and password. You are responsible for any unauthorized use of your account and/or password. In the event that a third party places a bet or is thought to have placed a bet from your account, such bet shall be valid and liability for losses on your account will lie with you, whether or not you were aware the third party misappropriated your account and password information. You agree to notify us immediately if there is any change to your account information.

6.7 You will not post any unlawful, obscene, abusive, defamatory, threatening or other offensive material on the Games Website or the Website.

6.8 You understand that you risk losing money whilst using the Games Website and playing Games and that you use the Games Website and play Games at your sole risk.

6.9 If any part of these Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Conditions.

The arbiter’s decision will be final (save in respect of any manifest error) subject to full representation being given to all parties involved. Part G - Standard Promotional Terms

These Standard Promotional Terms apply to all Paddy Power promotions and competitions. Except as expressly provided, in the event of any discrepancy or conflict between these Standard Promotional Terms and any specific promotional terms, then the specific promotional terms shall prevail.

1.             Eligibility

1.1 You must be aged 18 years or more to participate in promotions and/or take part in competitions. It is an offence for anyone under the age of 18 to open an account or to gamble. Underage entries will be void.

1.2 All promotions are limited to one entry per customer. To ensure that the promotion is limited to one entry per customer, we only permit one customer to participate from each household address, IP address, email address, telephone number, same payment account (e.g. debit or credit card, Neteller etc) or shared computer (e.g. public library or workplace).

1.3 None of the employees, nor any family members of employees, of Paddy Power and its affiliate companies, their agents, or those of their respective group companies may take part in prize draw promotions or competitions that involve any element of judgment by Paddy Power.

1.4 All promotions are available at the discretion of Paddy Power and Paddy Power reserves the right to restrict the availability of a promotion to any person. Any such restriction will not impact players who have already started wagering under a promotion.

1.5 If you have been sent an email excluding you from promotions you will not qualify any promotions. Please note that any such exclusion will not affect any free bet, bonus or other promotional offer you have already placed a qualifying bet towards. You will still receive the benefits of any promotion you have started qualifying for or already qualified for prior to this decision.

2.             Fraud and Multiple Accounts

2.1 Fraudulent or multiple entries will not be accepted, neither will entries made in breach of these Standard Promotional Terms or the specific promotional terms.

2.2 Paddy Power reserves the right to exclude any entrant from competitions and/or promotions and from use of the Paddy Power website if Paddy Power believes that an entrant has tried to enter by using more than one username or is otherwise engaging in any fraudulent or illegal activity (including participation that would be in breach of the law in your local jurisdiction), whether or not that entrant would or might have won any prize but for such activity. Where multiple entries/accounts have been used, Paddy Power reserves the right to cancel these accounts and withhold payment of the prize/bonus or any other promotional benefits.

3.             Bonuses

3.1 Bonuses are awarded to enhance your enjoyment of our games however we reserve the right to govern how bonuses are used before a player is allowed to cash them in. As such we deem it necessary to restrict certain types of wagering from contributing to the wagering/turnover requirements.

3.2 Any bonus issued is valid for a period of 7 days from the date of issue unless otherwise stated in the specific promotion. Any remaining/unused bonus at the end of the stated period will be removed from the player's account.

3.3 All bonuses credited must be ‘bought-in’ to, accepted or declined. Once accepted, a bonus is credited to your playable balance. Declined bonuses will not be reapplied.

3.4 Wagering requirements for bonuses will apply to an account from the time a bonus is accepted and/or applied to an account.

3.5 When receiving a bonus, the player will first play with the money ‘bought-in’ to and only then will the player play with the bonus offered by the casino.

4.             Irregular Play

4.1 If Paddy Power becomes aware of a customer who, in the course of participating in a promotion or offer, has become able to guarantee wins and/or profits with no or only minimal risk, and/or benefits from a promotion or offer by participating through more than one Paddy Power account, and/or displays irregular or unusual playing or betting patterns which Paddy Power deems to be abusive, Paddy Power may elect to do any one or more of the following: (i) close the customer’s account(s); (ii) invalidate the transactions or game play which was in contravention of this term; and/or (iii) withhold the customer’s winnings from such transactions or game play.

4.2 Paddy Power reserves the right to withhold any withdrawals and/or confiscate all winnings for irregular play. Irregular play includes, but is not limited to, any one or more of the following types of play:

(a)    Placing single bets equal to or in excess of 30% of the value of the bonus and deposit before the wagering requirements for that bonus have been met. For example, you deposit €/£100, accept a €/£100 bonus and place a single bet of €/£60 on any game.

(b)    Moving from a low weighted game (25% or less) to a high weighted game (100%) after large wins for the purpose of clearing wagering requirements. For example, you place at least one bet on any game weighted at 25% or less, win 100% more than your stake and move your original stake and winnings to a game weighted at 100% in order to meet wagering requirements.

(c)    Playing equal to or more than 500 auto spins on a Slot machine and/or playing a Slot machine consistently for a period longer than two hours while a bonus is active. For example, you set any game to run on auto spin for 500 spins while you have an active bonus in your account and/or you play for a period of two hours or more (irrelevant of how many sessions) while you have an active bonus.

(d)    Low risk Roulette bets. ANY bet spread combination on Roulette games covering 25 or more (67%) of the 37 unique number spots on the table. For example, you bet on Red and Black, you are covering 36 of the 37 possible outcomes, therefore this bet would not count towards any wagering requirements.

5.             Prizes

5.1 Prizes are not transferable or exchangeable other than at the sole discretion of Paddy Power.

5.2 Unless otherwise specified in writing, if you are required to travel as part of the promotion or as a competition prize winner, you are responsible for making all your own arrangements (including insurance).

5.3 We will attempt to contact all winning customers within 48 hours. If we cannot reach you within 48 hours, or if you do not claim your prize within 48 hours of being notified, we reserve the right to select a new winner.

6.             Publicity

6.1 If you win a competition or a promotion, Paddy Power may ask you if you wish to take part in publicity. If you agree to take part, Paddy Power can make reasonable use of your name and image on the websites and in promotional materials.

7.             Variation

7.1 Paddy Power reserves the right to amend any specific promotional terms, competition rules or these Standard Promotional Terms at any time. Any such change will not adversely impact players who have already started wagering under a promotion.

7.2 Paddy Power reserves the right to withdraw or vary the terms of competitions and promotions to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any entrant for so doing.

8.             General

8.1 By entering the promotion or competition, you accept and agree to be bound by these Standard Promotional Terms and any specific terms and conditions relating to the relevant promotion.

8.2 Any disputes relating to promotions or competitions will be resolved in accordance with the Paddy Power Dispute Resolution Policy, see here.

8.3 Paddy Power accepts no responsibility whatsoever for system or connection problems that might affect any end user during any of these promotions.

8.4 Paddy Power and its affiliates and subsidiaries, or any of their employees, officers or directors shall not be liable for any loss, costs, expenses, damages, injury or other liability arising from a participant's or winner's participation in any competition or promotion, or for any such modification, alteration, discontinuance or termination of any competition, promotional or tournament. Nothing in this clause shall operate to limit or exclude liability for personal injury or death caused by our negligence.

8.5 Customers located in the UK agree that these Standard Promotional Terms shall be governed by and construed in accordance with the laws of England and Wales and you submit to the exclusive jurisdiction of the Courts of England. Customers located outside the UK agree these Standard Promotional Terms shall be governed by and construed in accordance with the laws of Malta and you submit to the exclusive jurisdiction of the Courts of Malta.

8.6 The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and no rights or benefits expressly or impliedly conferred by it shall be enforceable under that Act against the parties to it by any other person.
